When a marriage is no longer working, either party or both parties may file for divorce with the court to dissolve the marriage.
In Missouri, legal requirements for divorce include residency in the state for at least 90 days. The state is a no-fault state, so there is no need to prove fault to be granted a divorce. The court may however, consider the following when deciding whether the marriage should be dissolved.
- Spouse committed adultery
- One spouse is unable to tolerate the behavior of the other spouse.
- Couple lived apart for at least 24 months, before the divorce was filed. 12 months if both parties agree.
- You were abandoned for at least six months or more continuous before the divorce filing.
- One of the parties is involved in criminal activity.
